Terms and conditions

Please read these Terms and Conditions carefully before using a service provided by Anderson Scottish Tours ("the Company," "we," or "us"). By booking a service (“tour,” “shore excursion,” or “airport transfer”) with Anderson Scottish Tours, you (“the customer,” “passenger(s),” or “booking holder”) agree to comply with and be bound by the following Terms and Conditions as listed below.

 

General Terms

·       For all bookings 20% of the total price will be considered ‘deposit’ and is non-refundable. 

·       You are responsible for booking your own accommodation and attractions where applicable.

·       We have the right to refuse service to anyone who is deemed disruptive, obstructive or acting in a manner that would be considered unsafe. This extends to anyone under the influence of drugs and alcohol. 

·       You are responsible for your own safety and belongings while engaged in our services.

·       Please notify us of any health, medical conditions or allergies which you think may help us in case of an emergency.

·      For wheelchair users, please be advised our vehicles are not wheelchair accessible and you will need to be able to safely embark/disembark the vehicle unassisted. If applicable, you must inform us of this during the time of booking.

·       We strongly recommend you have appropriate travel insurance in place for the duration of your travels.

·      The company reserves the right to sub-contract driver guide services and vehicles, should the need arise.

 

1. Bookings and Payments

·   To make a booking with us, you can use our online booking portal on our website. Simply select your tour or shore excursion, select the date and enter all the required information. You’ll have the option to pay the full amount or a 20% deposit, with the remaining balance due 31 days before departure.

·   Alternatively, if your tour or shore excursion requires any customisation by you then payment will be taken using a payment link sent via email from us. You’ll have the option to pay the full amount or a 20% deposit, with the remaining balance due 31 days before departure.

·   Bookings for services with dates within 31 days of departure are subject to full upfront payment.

·   For all bookings 20% of the total price will be considered ‘deposit’ and is non-refundable.

·   Failure to make timely payments may result in the cancellation of your booking without refund.

·   All payments must be made in Great British Pounds (GBP). The company is not liable for any financial loss due to fluctuations in the currency exchange rates. We accept most major credit or debit cards. We also accept direct bank transfer, however you are responsible for any charges incurred during the transaction.

 

2. Cancellation and Refunds

·       Cancellation requests must be submitted in writing by email to info@andersonscottishtours.com

·       If you cancel your booking more than 14 days before departure date then a full refund will be made minus the 20% deposit. If you cancel your booking less than 14 days before the departure date, then no refund will be made.

·       If for whatever reason we cancel your booking then a full refund will be made, with the exception of cancellation due to failure to make timely payments.

·       Certain non-refundable expenses, such as bank fees or third-party charges, may be deducted from the refund amount.

·       For shore excursion bookings only. In the event your ship is unable to dock then a full refund will be made minus the 20% deposit.

 

3. Booking Rescheduling

·       Rescheduling requests must be submitted in writing by email to info@andersonscottishtours.com

·       Rescheduling your booking is subject to availability of new dates.

·       If dates are available, your booking will be transferred free of charge if your request is made more than 31 days before departure. If your request is made within 31 days, then it will be subject to a 10% administration fee.

·       A new confirmation email will be sent detailing any changes.

·       If dates are not available then your booking will be subject to cancellation as outlined above. 

 

4. Accommodation and Attractions

·       You are encouraged to research and book suitable accommodations based on your preferences and budget.

·       We do not facilitate or manage accommodation bookings. However, we are happy to advise.

·       You are free to choose specific attractions you wish to visit as part of your bespoke itinerary.

·       The cost for accommodation and attractions are not part of the total booking price. These are booked by you and are subject to their own respective terms and conditions between you and the accommodation/attraction provider.

·       We recommend that attractions, for example castles, distilleries and some museums, are pre-booked as much as possible.

·       We recommend using the pay on arrival method if possible as this helps mitigate any possible financial loss if your booking is cancelled for whatever reason.

 

5. Tour Itineraries 

·      Planning your bespoke touring itinerary will be offered as part of the initial booking process.

·      Any ferry travel that is required will be booked and paid for by us and included in your overall booking cost.

·      Any accommodation required by the driver guide will be booked by us and included in your overall booking cost.

 

6. Itinerary Amendments

·       You have the flexibility to request amendments to your bespoke itineraries. We ask this be done before the departure date where possible.

·       Amendments are subject to availability and feasibility.

·       Amendments may incur additional charges or fees, depending on the nature and extent of the requested changes.

·       You are responsible for informing any third-party attractions and/or accommodation providers of the changes and the possible extra costs involved subject to their own terms and conditions between you and them. We will not be held financially liable for this.

·       We reserve the right to alter tour itineraries at any time, due to weather conditions, road conditions, traffic problems, breakdown of vehicles, breakdown of transport that use steam propulsion and availability of third-party transport providers such as ferries. No adjustment or refund will be offered in this case.

·       Any ad-hoc ferry travel caused by you amending the tour itinerary will be subject to immediate upfront payment.

 

7. Luggage

·      Luggage will be assumed to be one medium sized bag (approximately 63cm x 45 cm) per person. 

·      Please provide as much information as possible with regards to the number and size of luggage. Exact dimensions would be very useful.

·      We will endeavour to carry all luggage that you require. However, luggage space within the vehicle is ultimately finite and there are legal weight limits which the vehicle must adhere to.

·      If the amount of luggage exceeds what can be safely carried within the vehicle, then alternative arrangements will have to be put in place at your cost, such as storage or use of a third-party courier service.

·      Luggage is transported or stored at the owner’s risk.

·      Any wheelchairs or child strollers must be fully collapsible and will count towards the vehicle’s overall luggage capacity. 

 

8. Children

·      Children under the age of 18 must be accompanied by a parent or legal guardian. They are ultimately responsible for the conduct of the child. They must wear a seatbelt at all times.

·      By law your child must be put in a child car or booster seat until they're aged 12 or 135cms tall, whichever comes first. As a rule of guidance if your child uses a car or booster seat at home then it applies here.

·      We will have a small selection of child car or booster seats available for rental should the need arise. It is your responsibility to inform us of this during the booking process.

 

9. Customer Conduct 

·      You are responsible for your own conduct and safety while engaged in our services.

·      All passengers must wear a seatbelt at all times while the vehicle is in motion. 

·      The company will refuse carriage to anyone who becomes abusive or violent to anyone at any time while engaged in our services. The police will be contacted if necessary.

·      The company can refuse carriage to anyone who present themselves as under the influence of alcohol and/or drugs at any point while engaged in our services.

·      Any and all damages to company property will be chargeable back to you and the police will be contacted if necessary.

·      In the event of any of the above transpiring the service will be immediately terminated with no refund made.

·      Ejected passengers will be fully responsible for their own forward travel costs.

 

10. Smoking

·      Smoking, vaping and the use of e-Cigarettes while onboard the vehicle is strictly forbidden.

 

11. Photography and Marketing

·      By participating in our services, you grant the company the right to capture and use photographs or videos of you for marketing and promotional purposes, as described in our Privacy Policy.

·      If you do not wish to have your images used for marketing purposes, please inform a member of our staff or contact us in writing via email.

12. In-Vehicle Recording

·      As part of our commitment to safety and operational efficiency, our vehicles are equipped with fitted dash cams for the purpose of recording both, forward facing and in-vehicle activities. These dash cams are configured to capture video footage without sound. By participating in our services, you give acknowledgement this is taking place. You will find further information in our Privacy Policy.

 

13. Health and Safety

·      You must comply with all health and safety guidelines and instructions provided by our staff during services to you.

·      We reserve the right to deny participation to any individual who poses a risk to themselves or others, who fails to meet the physical or health requirements necessary to participate safely.

·      For wheelchair users, please be advised our vehicles are not wheelchair accessible and you will need to be able to safely embark/disembark the vehicle unassisted. If applicable, please inform us of this during the time of booking.

 

14. Force Majeure

·      The company does not accept liability for any loss, inconvenience or damage caused by war, threat of war, riot or civil commotion, terrorist or criminal activity, industrial disputes, natural disasters, fires, illness, weather conditions, road traffic conditions, temporary technical, electrical or mechanical breakdown.

 

15. Insurance

·      The company maintains insurance meeting all statutory requirements.

·       We strongly recommend you have appropriate travel insurance in place for the duration of your travels.

 

16. Entire Agreement

·      These Terms and Conditions constitute the entire agreement between you and Anderson Scottish Tours regarding the use of our services, superseding any prior agreements or understandings.

 

17. Severability

·      If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

 

18. Governing Law and Jurisdiction 

·      These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Scotland.

·      Any disputes arising from or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Scotland.
